News Briefs: June 19, 2023

The Promoting Access to Treatments and Increasing Extremely Needed Transparency (Patient) Act (H.R. 3561), which advanced out of the House Energy and Commerce Committee May 24 on a bipartisan vote of 49-0, includes some provisions with big implications for hospitals if it becomes law. For example, the bill requires all provider-based departments to submit attestations to CMS they comply with provider-based requirements at 42 C.F.R. § 413.65 by Jan. 1, 2026, said Martie Ross, a consulting principal with PYA, and Kathy Reep, a senior manager with PYA, at a June 14 webinar sponsored by the firm. Another provision requires a separate national provider identifier for every hospital outpatient department to bill government payers. Those are just two of the bill’s provisions affecting hospitals and other industry players.
