Physician Settles FCA Case Over Billing for Unapproved Cancer Drugs

An upstate New York physician, his oncology practice and his office manager agreed to pay $500,000 to settle False Claims Act (FCA) allegations that they billed Medicare Part B for chemotherapy drugs that weren’t FDA approved, the U.S. Attorney’s Office for the Northern District of New York said Feb. 8.

Vincent Koh, M.D., and his wife/office manager, Milly Koh, also pleaded guilty in November 2017 to receiving and delivering misbranded drugs, a misdemeanor, according to the Food and Drug Administration (FDA) and HHS Office of Inspector General.
