◆ CMS is asking everyone for ideas on how to reduce the burden of the Stark Law. On June 20, CMS put out a Request for Information (RFI) “focusing in part on how the law may impede care coordination, a key aspect of systems that deliver value.” This was expected. In April, Kim Brandt, CMS’s principal deputy administrator for operations, spoke at the Health Care Compliance Association’s Compliance Institute of striking “the right safeguard balance”—between protecting the Medicare program/patients and allowing providers to coordinate to promote efficiency and quality (RMC 4/23/18, p. 1).
